Su Barry is the principal and owner of Barry Apc and represents consumers and injured plaintiffs as well as top San Diego businesses such as Oscars Tacos, The Holding Company Ocean Beach, Gaslamp Quarter Entertainment, Cisterra Partners, Pacific Magazine, Vitality Tap and Epic Transportation. She has been selected for inclusion in Super Lawyers every year since 2015 and selected as one of the Top 25 San Diego Women Lawyers by Super Lawyers in 2018. She was also named to SD Magazine’s “40 Under 40” in 2017, and was honored in 2019 by the YWCA  in its Tribute to Women & Industry Awards. Born in Nairobi, Kenya.

Lived in Nairobi, Kenya; Tokyo, Japan; Dallas and Austin, Texas before moving to San Diego in 2000.

Formerly associated with the firms Levine, Steinberg, Miller & Huver and Hosey & Bahrembeygui, before starting her own practice.

Sample Plaintiffs’ Cases:

$37.5 Million Verdict. Cisterra Partners, LLC v. The Irvine Company, San Diego Sup. Ct. Case No. GIC783959. Su Barry joined lead counsel as part of the three-attorney trial team representing local San Diego developer, Cisterra Partners. After a three and a half month trial, a jury awarded Cisterra Partners $37.5 million. Case Type: Breach of Contract, Intentional Interference with Prospective Economic Advantage.

$5.5 Million Settlement at Trial. Foley v. City of Coronado; Aaron Mansker, San Diego Sup. Ct. Case No. GIC879075. Su Barry was part of the four-person litigation and trial team representing former San Diego Charger linebacker Steven Foley who was shot by an off-duty police officer. The case settled after two and a half weeks of trial for $5.5 million. Case type: Civil Rights – Police Misconduct, Excessive Force.

$7.3 Million Recovery. Cedar Fire Litigation. From 2005 to 2008, Su Barry worked with lead counsel assisting in the recovery of over $7.3 million in additional insurance benefits on behalf of Cedar Fire victims. Case type: Bad Faith Insurance, Fraud, Negligence.

$2.5 Million Settlement. Ms. Barry represented a Plaintiff in a breach of implied contract case. 2023.

$1.68 Million Settlement. Ms. Barry represented a client in a premises liability action. 2023.

$1.65 Million Settlement. Ms. Barry represented a San Diego couple in a bad faith lawsuit against their insurance company. 2018.

$1.41 Million Settlement. Ms. Barry represented minors in a wrongful death action. 2022.

$705,000 Recovery. Ms. Barry recovered $705,000 on unpaid promissory notes after filing suit and initiating foreclosure of the Defendant’s home to secure payment. 2022.

$700,000 Settlement. Ms. Barry obtained a $700,000 settlement for her client in a case against the U.S. Border Patrol after a Border Patrol agent crashed into her client’s vehicle. 2017

$625,000 Settlement. Ms. Barry represented a pedestrian who was hit by a car in an intersection requiring knee surgery. 2017.

$450,000 Settlement. Su Barry represented the Plaintiff in a premises liability action wherein her client suffered electric shock injuries. 2013.

$425,850 Settlement. Su Barry represented a Plaintiff in a chiropractic malpractice case as a result of a neck manipulation. 2014.

$410,000 Class Action Settlement. Ms. Barry represented a class of approximately 180 members who recovered an average of $1,300 per member. 2017.

$350,000 Settlement at Trial. Ms. Barry and co-counsel represented Plaintiff in a commercial lease dispute involving a restaurant/bar in Little Italy, San Diego. Case Type: Business Dispute. 2019.

$330,000 Settlement. Su Barry represented Plaintiffs in a medical malpractice action following a negligently performed laparoscopic cholecysectomy (gallbladder removal). 2018.

$332,211 Judgment. Ms. Barry obtained a judgment against her client’s HOA after a two week property damage trial wherein the jury found the HOA grossly negligent. 2015.

$200,825 Settlement. Ms. Barry represented the Plaintiff in a bad faith insurance action against her client’s insurance company for the unreasonable denial of insurance benefits. 2014.

$154,000 Settlement. Ms. Barry represented the Plaintiff in an insurance broker negligence action, alleging that the insurance broker negligently procured insurance coverage for her client’s business. 2013.

$140,000 Settlement. Ms. Barry represented the Plaintiff in a malicious prosecution action after Motions in Limine hearings at trial. Her client alleged that the Defendant previously sued Plaintiff without any basis and for an improper purpose. 2012.

$6.76 Million Recovery. Cedar Fire Pro Bono Assistance. From 2003 to 2005, Su Barry worked with lead counsel recovering over $6.76 million in additional insurance coverage for Cedar Fire victims, pro bono. She assisted over 150 victims with various insurance issues incident to property damage caused by the 2003 Cedar Fire.

Su Barry Foundation – – Established September 2018 – Supporting San Diego-based social service causes that improve the quality of human life through volunteering, grants/donations, and promoting awareness.

Sample Defense Cases:

Defense Verdict. Jane Doe v. Conor Brennan, et al., San Diego Sup. Ct. Case No. 2019-0041325 – Ms. Barry served as lead trial counsel representing the defendant. Plaintiff in this case alleged that she had been sexually assaulted while she was unable to consent (drunk). The jury trial commenced on July 26, 2021 and closed on August 25, 2021. The jury rendered its verdict two days later finding for Ms. Barry’s client on all five causes of action. Case type: Battery, Sexual Harassment, Constructive Discharge. 2021.

Defense Judgment. Simplon Ballpark LLC v. Jack Scull, et al., San Diego Sup. Ct. Case No. 2011-00084777 – Ms. Barry served as trial co-counsel representing defendant Jack Scull. Plaintiff in this case asserted that Jack Scull breached its operating agreement as well as his fiduciary duties to the company, which oversaw the $49 million acquisition and development of the property located between 7th and 8th and Island and J Streets in downtown San Diego. The bench trial in front of Judge Link lasted two and a half weeks and Judgment was ultimately entered on behalf of Jack Scull, after the reversal of an initial finding in Plaintiff’s favor. Case type: Corporate Dispute, Breach of Fiduciary Duty. 2012.

Defense Judgment. Ms. Barry represented a small business against an employee who claimed over $100,000 in unpaid wages. After a two-day hearing, Ms. Barry obtained a defense ruling and judgment in favor of her client. 2016.

Defense Settlement of $10,000 out-of-pocket where the Plaintiff claimed damages over $1.8 million. Ms. Barry represented a product retailer in a products liability action where the Plaintiff claimed damages in excess of $1.8 million. The case settled on the first day of trial. 2013.

Defense Settlement of $0. Ms. Barry represented a Defendant in an action to recover on a personal guaranty of a promissory note signed by her client. 2014.
